1. Acceptance
These terms govern your use of the Product Recommendations Shopify app (the “App”), provided by Nacelle (“Nacelle”, “we”, “us”). By installing or using the App, you agree to these terms. If you do not agree, do not install or use the App.
These terms are between Nacelle and the Shopify merchant who installs the App. They supplement, and do not replace, your agreement with Shopify.
2. The service
The App adds a carousel of recommended products to the cart and checkout pages of your Shopify store, with copy written in your brand's voice. Features may be added, changed, or removed over time.
3. Your responsibilities
- You are responsible for your Shopify account, your store's content, your product catalog, and your relationships with your shoppers.
- You are responsible for complying with applicable laws (including consumer-protection, advertising, and privacy laws) when using the App.
- You will not use the App to infringe intellectual-property rights, to transmit unlawful or deceptive content, or to interfere with the operation of the App or Shopify.
4. Privacy
Our handling of personal information in connection with the App is described in our privacy policy, which is incorporated into these terms by reference.
5. Fees
Fees for the App, if any, are as stated on the App's Shopify App Store listing at the time of install. Billing is handled by Shopify.
6. Intellectual property
The App, including its software, design, and documentation, is owned by Nacelle and its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable right to use the App in connection with your Shopify store while these terms are in effect.
You retain ownership of your store's content (including product data and brand-voice inputs you provide to the App). You grant us the rights necessary to process that content in order to provide the App.
7. Disclaimers
The App is provided “as is” and “as available” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or that recommendations will produce particular commercial results.
8. Limitation of liability
To the maximum extent permitted by law, Nacelle will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or goodwill, arising out of or related to your use of the App. Our aggregate liability arising out of or related to the App will not exceed the greater of the amounts you paid us for the App in the twelve months preceding the event giving rise to liability, or [amount — pending legal review].
9. Termination
You may stop using the App at any time by uninstalling it from your Shopify admin. We may suspend or terminate your use of the App if you violate these terms or if we discontinue the App. Sections intended to survive termination (including intellectual property, disclaimers, limitation of liability, and governing law) will continue to apply.
10. Changes
We may update these terms from time to time. When we do, we will update the “Last updated” date above. Your continued use of the App after changes take effect constitutes acceptance of the updated terms.
